Case against Zardari's co-accused quashed

HYDERABAD, Oct 30: The fourth additional district judge here on Saturday quashed a murder attempt case against the co-accused of People's Party Parliamentarians' leader Asif Ali Zardari by allowing an application seeking quashing of the case against three Ansari brothers.

Qurban Ali H. Chohan, advocate, had filed the application on behalf of former senator Abdul Latif Ansari and his brothers Abdul Hafeez Ansari and Abdul Shakoor Ansari.

The case had been lodged by Sardar Usman Almani, son of the killed federal secretary Alam Baloch, against Mr Zardari, his father Hakim Ali Zardari and the Ansari brothers with the Qasimabad police.

Mr Chohan had contended in the application that none of the prosecution witnesses had turned up for deposition.

Relying on a Supreme Court judgment, he said that the case could be quashed at this stage because trying the case would be abuse of process of the court.

He argued that there was no likelihood of the accused being convicted and it was not relevant whether the accused had been arraigned in the case or not as the court could order the quashment at this stage.

Referring to charges contained in the FIR, he said that the murder attempt had not taken place and the complainant had admitted that an enmity existed between him and accused.

He said that neither any one had been injured nor the complainant's car damaged in the incident mentioned as the murder attempt in the FIR.
