PESHAWAR: Sessions judge asked to probe police raid

PESHAWAR, Oct 18: The Peshawar High Court on Monday ordered the district and sessions judge of Karak to conduct an inquiry into an alleged illegal raid on the residence of a petitioner by the local police.

A two-member bench comprising Justice Malik Hamid Saeed and Justice Qaim Jan Khan in their order observed that the sessions' judge had the powers to inquire into the matter and to provide justice to the petitioner, Habib Gul.

The petitioner stated that a few days back SHO of Karak Police Station Amin Khan raided his house and took away valuables and money. He claimed that the police had taken away 10 tola of jewellery, Rs53,000 cash, a TV set, a rifle and other items.

The petitioner said the police had also filed fake cases against his son Hameedullah and his three nephews, Mukhtiar, Ghaniur Rehman and Wasil Khan. He requested the court to issue directives to the Karak police for returning the looted items. He also requested the court to quash the cases against his son and nephews.

Bashir Khan Tanghi advocate appeared for the petitioner and contended that the petitioner and his relatives were not required in any case thus the raid on his residence was illegal. He pointed out that the petitioner lived in the Sabirabad area which was not even situated in the jurisdiction of the Karak police station.

PLEA DISMISSED: The Peshawar High Court on Monday dismissed bail petitions of two persons accused of killing a woman.

A single-bench comprising Justice Tariq Pervez observed that on the basis of the evidence available on record the two petitioners, Sakhawat Shah and Mathlab Shah, were not entitled to be released on bail.

The petitioners were accused of killing a woman Razina in the jurisdiction of Rustham Police Station, Mardan, on Oct 22, 2003. Zamin Shah, husband of the woman, stated that when he along with his wife and son came out of their house the accused opened fire on them which resulted in death of his wife. The motive behind the murder was stated to be personal enmity.
