KARACHI: SHC puts off hearing of teachers' plea


KARACHI, Oct 18: A division bench of High Court of Sindh, comprising Justice Wahid Bux Brohi and Justice Rehmat Hussain Jaffery, on Monday put off hearing of a constitutional petition filed by 300 teachers of the Nai Roshni Schools.

Earlier, counsel for the Sindh education department requested for a month's adjournment so that the matter be sorted out. The bench allowed the request.

Mohammad Rais and 299 other teachers moved the court seeking directions to the respondents, including the Literacy and Mass Education Commission, the federal secretary of education, Sindh education secretary and others to order posting of the petitioners after their absorption as primary school teachers in BPS-7.

They maintained that they were appointed under the NRS and were civil servants but after general elections of 1988, NRS scheme/project was shelved and their services were transferred to respective provincial governments.

The petitioners maintained that they were deprived of posting. Interestingly, a judgement was passed by a bench of the SHC in 1997, but its implementation is still awaited.

RELEASED: Justice Amir Hani Muslim of the Sindh High Court who is also administrative judge of the anti-terrorism courts in Karachi on Monday ordered release of two activists of the proscribed Hizbul Tehrir on bail, arrested on charges of distribution of pamphlets.

Faraz Mohammad Fateh and Syed Salman Hasan were arrested two days back from Gulistan-i-Jauhar and Super Market, Liaquatabad area, Karachi.

Police charged them with distributing the prohibited pamphlets of Hizbul Tehrir in which government policies and British and US governments were criticized and people were appealed to join hands with the Hizbul Tehrir.

Today accused were produced before court for police remand. The IOs, however, stated on AJ's query that there was no proof of the allegation that they were distributing the pamphlets.

The AJ after statements by the IO observed the prima facie case is made out under section 11 (F) (2) which is bailable and in view of Section 21 D (2) of ATA Act, the IOs may release the accused and submit their report within seven days.

The accused were directed to participate in investigation and appear before the court on the next date of the hearing which was fixed on Oct 25.-APP/PPI
