Hearing in $345m lawsuit adjourned

ISLAMABAD, Sept 29: Civil Judge Aamer Saleem Rana on Wednesday adjourned hearing into a $345 million lawsuit of infringement of intellectual property rights filed by Dr Syed Iqbal Raza against Siemens AG Germany and others till October 7.

The court was to record the evidence of Dr Raza but the Siemens counsel Azizul Aman Zubairy filed an application with the court for constitution of a high level judicial commission headed by a retired Supreme Court judge to record the witnesses.

The court after hearing arguments from both the sides adjourned the hearing till October 7. Dr Raza, a Pakistani physician, had filed the lawsuit against Siemens A.G Germany, Siemens Medical Solutions Health Services (USA) and Siemens Pakistan.

The suit alleges that Siemens copied and infringed Dr Raza's intellectual property rights in its ground-breaking medical industry software "Soarian" from his work spread over 10 years of research.

It is alleged that Siemens had received 161 concept papers of a medical industry software, Dr SIR, in 2000 from German Embassy in Islamabad, which had got these papers from Dr Raza.

Later on in 2002, it came to light that Siemens Medical Solutions USA had launched its own software "Soarian" which was strikingly similar to the concept paper of Dr Raza.

In 2003, Dr Raza filed a case of damages for infringement of his intellectual property rights against Siemens and others and claimed damages of $345 million for the infringement of his intellectual property rights.
