Asif's acquittal application


KARACHI, Sept 23: A second application for acquittal under Section 265-K of CrPC was filed before District and Sessions Court, East by Asif Ali Zardari, main accused in the murder case of Mir Murtaza Bhutto , Ashique Hussain Jatoi and six others of PPP (Shaheed Bhutto) in September 1996.

Barrister Azizullah K. Shaikh, counsel for applicant accused, moving the acquittal application submitted that no evidence, direct or circumstantial, oral or documentary or else was available in record to establish any controversy entered into by Asif Ali Zardari with any group of persons, namely Karachi Police group or others to kill Mir Murtaza Bhutto.

Relying on medical evidence given before the trial court, the counsel maintained that after examination of MLOs and few others, it has been established now that Mir Murtaza was unable to utter a single word due to injuries sustained by the deceased in his cheek and neck.

The medical evidence showed that Mir Murtaza was choking with blood and was unable to talk. He could not have uttered the words that "Asif has succeeded in getting us killed at the hands of Karachi police", he contended praying the court to acquit Asif Ali Zardari. -APP
