KARACHI: LG dept asked to withdraw notification


KARACHI, Sept 19: District Coordination Officer Mir Hussain Ali has asked the Sindh Local Government department to withdraw a notification issued earlier this year, which says that no other law than the Sindh Building Control Ordinance is applicable on the KBCA, as it clashes with the SLGO.

In a letter to additional chief secretary, the DCO said as per the notification, Sindh government had created the Building Control Group of office, which provided for legality to the KBCA as a part of the city government.

He said according to Section 27 (2) of the SLGO, the group of offices was to be headed by an executive district officer, which implied that the chief controller of buildings was an EDO as per the SLGO.

The DCO pointed out that as per section 28 (2), the DCO would be the coordinating head of the district administration, and initiate the performance evaluation report of all the EDOs.

The expression, 'coordinating head', had been defined as the authority to review and assess the performance of the group of offices, individually as well as collectively, the letter said.

The DCO said this was also supported by rule 6 and 7 of the District Government (Conduct of Business Rules) framed by the Sindh government. He said under the SLGO, the section 3 override all other laws and no office or group of offices functioning within the CDGK could be declared to be excluded from the SLGO.

The DCO said that these facts clarified that the KBCA was part of the district government, and that the DCO, as administrative head of the CDGK, was totally authorized to monitor the working of all the CDGK departments. -APP
