HYDERABAD, Aug 25: A division bench of the Sindh High Court, Hyderabad circuit, on Wednesday issued notices to the Sindh home secretary, the provincial police officer
, the SP (investigations) of Dadu and the SHO of Thana Bula Khan on a petition filed by the brother of an attack victim, expressing no confidence in the investigation of the case.
The petition has been filed by Vishnumal, the brother of senior medical officer of Thana Bula Khan Taluka Hospital and landlord Dr Tek Chand who has been seriously injured in an armed attack in the hilly area.
The petitioner alleged that Malik Alauddin and some of his relatives were land-grabbers. He added that in order to grab land of Dr Chand, Alauddin and his associates issued threats to him.
He said that Dr Chand had installed two water pumping machines in the wells and he had obtained permission for installation of another machine. On August 7, he alleged that at the instance of Alauddin, his armed servants maltreated Dr Chand's peasants - Imamuddin and his brother Najab - and torched their household articles and government machinery.
He alleged that the men also maltreated Ali Nawaz of the agriculture engineering department, who was supervising work on the land. According to the petitioner, a case was lodged with the Thana Bula Khan police by Imauddin but police did not take any action those nominated in the FIR.
Ali Nawaz lodged another FIR regarding destruction of the government machinery. He said that on August 10, Dr Chand and he went to Thana Bula Khan bus stand. On the way, they saw Malik Babar and Malik Humayun, the sons of Allauddin; with Malik Naseer and Raza Mohammad.
Mr Vishnumal alleged that Babar opened fire on Dr Chand and Humayun, Naseer and Jokhio hit him with pistol butts. As people of the area rushed towards the scene, the accused fled, he added.
The petitioner alleged that police again was not properly investigating this case and had adopted a partisan attitude, giving latitude to the accused to go scot-free. He said that on his application, the chief secretary of Sindh advocated change of investigation to some other officer.
The petitioner prayed the court to direct the PPO of Sindh to transfer investigation to an honest police officer or to another agency like the crime branch. He also requested the court to provide protection to him and his family members.
Vishnumal has also sent a letter to the court which has been converted into a petition and listed with his constitutional petition. In the letter, he alleged that police had arrested Alauddin but he had been being given a VIP treatment in police custody. The remaining accused were roaming about with impunity, he added.
The SHC bench, comprising Justice Atta-ur-Rehman and Justice Amir Hani Muslim, directed the additional advocate-general of Sindh to obtain comments from the police officials.
