AJK court again warns law officers

MUZAFFARABAD, May 25: In less than a week, AJK Shariat Court Chief Justice Syed Manzoor Hussain Gillani has again warned the law officers of the government to be careful in filing appeals against the acquittals by the subordinate judiciary.

If no case was made out against the acquitted accused, the appeal would amount to malicious prosecution entitling the accused to damages besides disciplinary action against the officers responsible for initiating such baseless proceedings, he said.

He observed this while dismissing an appeal against the decision of tehsil criminal court in Abbaspur whereby the accused respondents were acquitted of some charges under Section 337 of the CrPC. The trial court was justified in acquitting the accused, the CJ held and dismissed the appeal filed by the state.
