KARACHI: SC upholds high court decision


KARACHI, May 4: A bench of Supreme Court of Pakistan, comprising Justice Rana Bhagwandas and Justice Syed Deedar Hussain Shah, on Tuesday dismissed a leave to appeal seeking cancellation of the bail granted to four persons accused in a murder case.

Abdul Haleem Lakho moved the court challenging the impugning orders of the Sukkur bench of SHC which granted bail to accused Abdul Karim, Abdul Shakoor, Abdul Sattar and Abdul Khaliq.

The accused allegedly killed Ghulam Nabi Lakho, brother of appellant, for old enmity. Abdul Mujeeb Pirzada, appearing for the appellant, sought cancellation of bail on the ground that the accused were named in the FIR, specific role was assigned to them and that they remained absconder for a long time.

Khawaja Naveed Ahmed, counsel for respondents, in his arguments submitted that three investigating agencies exonerated the accused and only crime branch implicated them.

He said that enmity existed between the parties since last 15 years. Khawaja Naveed also submitted that the SHC bench rightly used its discretion. The bench after hearing the sides dismissed the leave to appeal upholding the decision of SHC. -APP
