HYDERABAD, Dec 27: A division bench of the Sindh High Court, Hyderabad circuit, the other day decided that the no-confidence motion passed against a union council Naib Nazim was against the law because the Nazim was not heard by the house.

Qasim Lund filed the petition against secretary local government, district coordination officer, district Nazim and union council Piaro Lund, stating that the UC had 21 members with one seat vacant as UC Nazim expired a year back.

He said according to the Sindh Local Government Ordinance powers of Nazim were to be exercised by the petitioner. He said in his absence acting Nazim Ghulam Murtaza Thebo entertained a motion which was not on the agenda.

Mr Lund said the motion was presented by Sain Bux Lund and it was moved for discussion and by getting vote through a show of hands 15 members backed the resolution which was adopted by the council.

He said the respondent DCO sent a reference to the district Nazim for issuance of notification. His counsel argued that voting was to be done through a secret ballot under Section 92 (4) of SLGO 2001 and that agenda for the day did not contain item of motion to be moved in the UC meeting.

Additional advocate general Masood A. Noorani contended the petitioner was condemned unheard and his fundamental rights had been violated.

The court noted the petitioner had no knowledge of any move to be taken up against him in the meeting and that he was to be confronted with allegations in order to enable him to vindicate his position.

The court nullified the proceedings with regard to the no- confidence motion.

BAIL: The Sindh High Court, Hyderabad circuit bench, on Friday granted bail to Khuda Dino an accused involved in the alleged murder of seven people.

Lawyer Hidayatullah Abbasi represented the accused against whom a case was lodged at the police station Saeedabad on July 27.

The court asked applicants counsel to deposit two sureties of Rs2 lac each in the case.

HDA SLATED: Latifabad Taluka Nazim Abdul Jabbar Khan has lashed out at the Hyderabad Development Authority for not cooperating with the Latifabad taluka municipal administration.

Speaking at a session of the taluka council here on Saturday, he said the non-cooperation was creating problems for the people.

He demanded that the HDA should be devolved at taluka level.

He said if the HDA did not improve its performance, elected representatives would protest and block offices of the HDA.

Mr Khan demanded that action should be taken against officials who were responsible for the death of a minor boy, who fell into an open drain.

He said the staff of the HDA were not working properly in Latifabad.

He said the grant that was approved for the HDA should be released to it so that sewerage schemes could be carried out in the Latifabad taluka.

The Nazim said several letters had been written to the Sindh governor and the chief minister in this regard but in vain.

He said sanitation work in union council-6 was being given on contract basis to make it effective. He said if the system worked properly, it would be introduced in other union councils as well.

He urged President Gen Pervez Musharraf to clarify whether the HDA was to be devolved or not.
