HYDERABAD: SHC seeks advice from AAG about unfit officials

HYDERABAD, Dec 4: The Sindh High Court, Hyderabad circuit bench, on Thursday asked the additional advocate-general, Sindh, Masood A. Noorani, as to what should be done in cases in which government functionaries were not discharging their duties.

Since the court intended to pass a general and detailed order, the additional advocate general sought time to examine the latest case to facilitate the court to pass a general order in identical matters wherein the directives of the court were sought for implementation of certain rules and regulations by the delinquent officials.

The matter related to one Maula Bux who had filed a contempt of court application before the court against the director, Building Control Authority, Hyderabad, Masood Ahmed Jamali; its deputy director, Imran Hassan, and a private person, Attaur Rehman.

The applicant sought implementation of the high court order, passed by the bench on May 28, ordering that encroachment on public lane by either party should be removed by the parties concerned within three months and removal should be supervized by the director, Building Control Authority, and a compliance report should be submitted.

The applicant said that a major portion of the public lane has been encroached upon by Attaur Rehman by constructing shops and flats, blocking the entrance and exit from the public lane.

After May 28 when the order was passed, the applicant approached the authorities concerned through a letter dated June 30 and asked them to fix any date and time for removal of the encroachment.

He said that when he met with the assistant director, Building Control Authority, the latter threatened him with dire consequences, insulted the petitioner and made it clear that they were not going to demolish the encroachment.

He said that he also threatened to cancel the approved plan of his house.

He said that the contemners refused to implement the order despite a lapse of three months.

He prayed the court to take action against the contemners since they had violated the high court order.

In his petition, he argued that Attaur Rehman did not pay any heed to his requests and continued illegal construction work and after completing unauthorized construction of shops, the respondent started construction on the roof of the shops.
