LAHORE, Nov 14: The Lahore High Court office said on Friday the writ petition against raise in salaries and allowances of parliamentarians was not maintainable and could not be fixed for hearing as a copy of notification in this regard was not enclosed with it.

The petition was filed by Advocate M.D. Tahir who had questioned the raise allowed to parliamentarians on grounds that this was discriminatory because no other class of society had been given relief. The raise was also an anomaly keeping in view their performance since the installation of new parliament following the October 2002 elections.

The petition has been returned to Mr Tahir who said he would remove the deficiency by procuring the notification.

BADR CASE: The LHC on Friday allowed the deputy attorney-general five days for the submission of a report on the contention of PPP leader Jahangir Badr that his name be removed from the exit control list.

The deputy attorney-general sought four weeks for a government reply on the issue, but the court declined to comply with the request.

In his petition, Jahangir Badr submitted that his name was put on the ECL in 1999. He stated the validity of his passport was due to expire in December, and the passport officials, working in subordination to the Interior Ministry, were not allowing him a fresh passport or the renewal of the old one.

NO HEARING: The writ petition challenging the decision of Gen Pervez Musharraf for removing President Rafiq Tarar and taking over this office could not be taken up by the court on Friday due to the absence of a judge from the division bench.

Justices Chaudhry Ejaz Ahmad and Mian Saqib Nisar are members of the division bench hearing the petition, filed by the Pakistan Lawyers Forum through its president, Advocate A.K. Dogar. As Justice Saqib Nisar is abroad, the hearing has been deferred.
