SC refers ex-MNA’s case back to NAB

Published October 25, 2003

ISLAMABAD, Oct 24: The Supreme Court on Friday disposed of a petition of Haji Nasimur Rehman, former ANP MNA, seeking annulment of his sentence by NAB Court.

The court asked him to go back to the trial court for getting himself cleared of the charge.

Haji Nasimur Rehman, represented by Advocate Munir Ahmad Paracha, stated that the Accountability Court has acquitted his client in the main reference and the sentence awarded to him for his non-appearance should also be quashed.

The top court had granted bail to Haji Nasimur Rehman when he was an absconder and also directed the State functionaries not to arrest him without court’s prior approval.

NAB filed a review petition, stating that the Supreme Court had made a departure from the settled law by allowing the facility of bail to a fugitive of law.
