KARACHI, Oct 6: The Sindh High Court ordered on Monday inspection of a plot in the PECHS and its sealing if found being misused by its owner.
The owner had instituted a suit against the Karachi Building Control Authority for not allowing him beneficial ownership and use of his plot (No 159) in Block 3 of the PECHS. Justice Ataur Rahman passed an interim order asking the owner to use the premises for residential accommodation in terms of the allotment letter. The defendant KBCA was asked to refrain from disturbing the owner’s peaceful possession of the plot.
The authority complained through its counsel on Monday that the owner had allowed a chain of schools to establish an institution on the plot. Justice Rahman asked the SHC Nazir to visit the premises and seal it off if it was being misused as alleged.
LYARI ESTUARY: Justice Zia Perwez, meanwhile, rejected a claim that the estuary of the river Lyari was owned or could be leased out by the Karachi Port Trust. The dispute arose in a suit moved by Modern Terminal Operators against the city district government. The plaintiffs submitted that they had been leased out two plots by the KPT on the river estuary but the city government was interfering with their use and possession.
Justice Perwez held that the ownership of river banks or estuary could not be claimed or leased out by any agency. The suit was dismissed as not maintainable.
MURDER CASE: Justice Muhammed Ashraf Leghari of High Court of Sindh on Monday acquitted two accused in a murder case while disposing of their appeals.
Syed Hamid Ali and Imran were sentenced to serve life imprisonment by additional district and sessions judge, Judicial Complex Bashir Ahmed Khoso, on charge of killing one Zahid Hussain, adds APP.
The bench after hearing the state counsel allowed the appeals setting aside the conviction and sentence awarded to them.
BAIL GRANTED: A bench of High Court of Sindh, comprising Justice Muhammed Sadiq Leghari, on Monday granted bail to an accused in murder case against a surety of Rs100,000.
Syed Zubair Ali alias Zubair Kala sought bail in a case registered against him by the Gulistan-i-Johar police for killing one Mohammed Younus.
According to prosecution, on Dec 7, 2002, Mohammed Yousuf, father of the deceased, lodged a complaint against unidentified gunmen who shot dead Younus whose body was found near Iqra Complex. The police first arrested Waheed Ahmed and later the applicant two days after the incident.
Khawaja Naveed Ahmed, appearing for the applicant, submitted that the applicant was not named in the FIR. No role was assigned to him except his presence. Neither any enmity or recovery was established against the accused, submitted Khawaja Naveed Ahmed, adding that case had not progressed till Monday although accused/applicant was behind the bars for the last eight months.
The bench after hearing the counsel admitted the accused to bail against a solvent surety of Rs100,000 and personal bond in the like amount.
