KARACHI, Sept 9: A division bench of the High Court of Sindh, comprising Justices Sabihuddin Ahmed and S. Ali Aslam Jafri, on Tuesday took notice of a letter by the Nazim of Karachi, Naimatullah Khan, and summoned the executive district officer (EDO) on law to explain the legal position on Oct 1.
The court also put the advocate-general of Sindh on notice to assist the court.
The bench was hearing a constitutional petition, filed by the Citizen Advice Forum against the Karachi Building Control Authority, seeking demolition of additional floors and shops illegally built on plot 841 (KIA), Khadda, Lyari Town.
Earlier, Shahid Jameel Khan, counsel for the KBCA submitted a report of compliance in respect of orders passed by the bench, issued on April 3, wherein the KBCA was required to take all necessary actions under the relevant laws against
the illegally-constructed structure.
The KBCA counsel submitted that the KBCA had demolished the fifth floor and also had requested public utility organizations to cut off the supply of electricity, water, sewerage etc to the illegally- constructed portions.
The KBCA lawyer also submitted a letter written to DIG (Operations) of Karachi informing him of inaction by the area police and soliciting assistance in the eviction of illegal occupants of the fourth floor of the building. — APP
