PESHAWAR, June 23: A single bench of the Peshawar High Court on Monday granted bail to two persons charged with murder and molestation of a boy.
The applicants, Lal Gul and Yousaf, claimed that they were falsely implicated in the case.
They were arrested by the police on the basis of statement of the prime accused, Tariq Khan, who is behind the bars.
The deceased, Mohammad Hussain, aged about six years, had disappeared from his residence at Gudbano village, Takhtbhai, and later his body was found by his relatives.
The father of the deceased, Mir Wali, had lodged an FIR at Takhtbhai police station on Dec 31, 2001. He had not charged any person and stated that he had no enmity with anybody.
The police arrested the prime accused, who in his confessional statement claimed that the applicants were with him when they took away the boy. He claimed that both the accused molested the boy and killed him when he shouted.
Advocate Murtaza Durrani appeared for the applicants and argued that a compromise had been reached between both the parties. The bench comprising Justice Malik Hamid Saeed pointed out that an accused could not be released on the basis of compromise in cases falling under the Hudood laws.
Mr Durrani argued that they were not directly charged in the case and they could not be held responsible for the commission of the offence on the basis of the confessional statement of another accused.
