ISLAMABAD, June 13: The Uch Power Limited (UPL) has clarified that it had not declared any force majeure vis-a-vis the Oil and Gas Development Company Limited (OGDCL) and rather it rejected two notices issued by OGDCL on it.
Commenting on a Dawn report of June 4, UPL said “out of abundant caution and to protect our rights, we have claimed corresponding protection under the force majeure provisions in our power purchase agreement with Wapda, should OGDCL pursue its claims and succeed in establishing force majeure under its contract with Uch Power.”
However, the company said, it has not issued notice of termination to the government of Pakistan, Wapda and OGDCL in respect of any agreement it has with those parties.
The 586-mw Uch Power said it had been operating on maximum capacity and meeting Wapda despatch requests since January with OGDCL providing the required quantity of gas.
The Dawn report was based on a summary submitted to the economic coordination committee of the cabinet.
