KARACHI: Convicts’ plea in drug case admitted


KARACHI, June 13: A division bench of Sindh High Court, comprising Justice Anwar Zaheer Jamali and Justice Mujeebullah Siddiqui, on Friday admitted appeals of two convicts for regular hearing against life imprisonment awarded to them by a narcotics court in drug smuggling case and put state on notice.

The appellant Ismail and Rafeeq were arrested by police on July 23, 1997, when they were coming from Hyderabad to Karachi and the police recovered 33 kgs of charas from their possession.

They were tried and convicted in CNS court and trial court judge sentenced them to life imprisonment in drug smuggling case.

Both appellant moved the SHC against conviction and prayed to the court to set aside the sentences.

NOTICE TO NAZIM: A division bench of High Court of Sindh (SHC), comprising Chief Justice Sayed Saeed Ashhad and Justice Mushir Alam, on Friday issued notice to the Nazim of Saddar Town while hearing a constitutional petition challenging forced closure of a water hydrant.

Abdul Wakil of Wakil Hydrant Service impugning an order of the Town Nazim contended that he was a licensee and had been running the hydrant with due permission of the concerned authorities.

The petitioner also maintained that the petitioner had already called into question vires of KMC (Control and Regulation of Hydrant) Bye Laws, 1994. The water for industrial and purposes other than drinking was being supplied from the hydrant, the petitioner maintained.

The bench after hearing the counsel issued notice to Nazim, Saddar Town for a date to be fixed later by the office of the court.

BLAST CASE: A convict in bomb blast case on Friday filed an appeal in Sindh High Court against 30 years’ RI awarded to him by an anti-terrorism court.

Appellant Sabir Ali Waseem, an activist of banned Sipah-i-Sahaba Pakistan was sentenced to total 30 years RI, and ordered to pay a fine of Rs.1, 00,000 and his movable and immovable property was attached by ATC-II Karachi on June 7.

He was charged with launching anti-tank rocket (BM-107) that pierced through wall of commerce college on Dr. Ziauddin Road Karachi on Nov 23, 2001.—APP/PPI
