KARACHI: Review petition against NSC dismissed


KARACHI, May 19: A division bench of the Sindh High Court, comprising Justice S. Ahmed Sarwana and Justice Zia Pervez, on Monday dismissed a review petition filed by Sohail Hameed advocate, against an SHC order, and praying to declare constitution of the National Security Council as without lawful authority.

“There is no cavil about the proposition of law. This application is superfluous and dismissed,” the court held.

The petitioner filed a review appeal for accepting his petition and prayed to declare the constitution of the NSC and the order made by it as without lawful authority.

The SHC had dismissed petition No.1077/2000 on Oct 19, 2000, filed by the petitioner in person challenging the constitution of the NSC and also cost petitioner to Rs15,000 as it was superfluous.

He stated that the High Court had power of a judicial review under Article 199 of Constitution and prayed for same relief relying on Supreme Court judgment, which upheld the power of judicial review by court.

He further stated that he has filed appeal against SHC’s order of imposition of penalty before Supreme Court and requested that hearing of this application may be adjourned for some time. On which the court adjourned the matter after summer vacations.—PPI
