ISLAMABAD, May 6: The Central Board of Revenue (CBR) has been asked to assess the income of taxpayers for levy of tax after seeking complete information from authentic sources.
Federal Tax Ombudsman (FTO) Justice Saleem Akhtar (retired) on Monday observed that in a large number of cases, the CBR considered the sales declared by the assessees as authentic, though these were less than those estimated by the survey teams, however the case in point was vice versa.
Taking decision on the complaint of Mohammad Aslam, the FTO said the complainant declared his sales at Rs4.85 million while the survey team estimated the sales at Rs4.5 million. But the CBR declared the complainant’s sales at Rs7 million, he added.
The FTO said in cases where in survey estimate was binding on the assessee, it should be binding on the department as well. The department is following double standards, which is very inappropriate and unjust, he added.
The ombudsman recommended to the CBR that the sales declared by the complainant at Rs4.85 million be adopted for the assessment year 2000-01. He said, ‘enquiries should be made to determine whether the petitioner is a retailer or a whole-seller for the purpose of application of GP rate.’
