PESHAWAR, Feb 11: The prosecution service awaits a cabinet decision about its future status and a proposed law dealing with its powers and functions, it is learnt.
Sources say that a summary has been moved for placing the prosecution service under the home department. The provincial cabinet is likely to take a decision after Eid whether to place the service under the home department or to keep it attached to the law department.
The cabinet is also expected to give approval to the proposed NWFP Prosecution Service (Creation, Functions and Powers) Ordinance, 2003. It is not clear whether the proposed law will be promulgated in the form of an ordinance or a bill will be moved in the provincial assembly for making it an act.
For establishing a uniform system of prosecution service in all the provinces, the proposed ordinance was drafted by the federal government and sent to the provincial governments about four months back. As the prosecution service is a provincial subject, the provincial governments will decide whether to enact the draft law in its original shape or to tailor it according to their needs.
Previously, the prosecution branch was attached to the police department. Under the police reforms it was separated from the police department and attached to the law department.
