KARACHI, Jan 23: A division bench of the Sindh High Court while accepting on Thursday appeals of three accused ordered their release, if not required in any other case.
The bench comprised Justice Wahid Bux Brohi and Justice Muhammad Moosa K. Leghari.
According to the prosecution, two persons were killed by unidentified assailants on October 8, 1998, and it was reported by a victim’s nephew Shahzad at TPX police station.
Police arrested Muhammad Qasim, Muhammad Alam and Adnan alias Abu Hashim on a charge of killing two persons. Two witnesses, Khushi Muhammad and Furqan, recorded their statements against them.
They were tried in the anti-terrorism court-III. Judge Arshad Noor Khan awarded them death sentence on the charge of killing Fazal Saeed and an unidentified person.
They moved the SHC against the conviction, and the court appointed Mahmood Alam Rizvi and Ataullah Khan, advocates, on behalf of the petitioners as they requested the court from jail.
The court observed that the incident took place at night and witnesses recorded controversial statements. Moreover, police did not arrange identification parade of the accused. — PPI
