PESHAWAR, Jan 2: The additional district and sessions judge, Khwaja Wajihuddin, here on Thursday summoned high-ranking police officers in connection with keeping a person in illegal detention.

The court directed that the respondents, including the capital city police chief, senior superintendent of police (SSP), Peshawar, the chief of Crimes Investigation Agency (CIA) and the station house officer (SHO) of the Police Station East Cantt, should appear before the court on Jan 4.

The court issued the directives on a habeas corpus application filed by a citizen, Hazrat Gul. The applicant stated that on Dec 23, 2002, the officials of the police station arrested his son, Amjid, without registration of an FIR.

He stated that later on, his son was handed over to the CIA. The applicant claimed that now both — the police station East Cantt as well as the CIA — express ignorance regarding the whereabouts of his son.

The applicant contended that keeping his son in detention without any charge and registration of an FIR was illegal, unconstitutional and against the law.

He added that his detention was contrary to section 491 of the Criminal Procedure Code.

Warrants Issued: The court of additional district and sessions judge, Sardar Muhammad Irshad Khan, issued arrest warrants of a skin specialist, Dr Taskeenuddin, due to his non-appearance before the court.

The court directed the concerned police to produce the doctor, serving at Lady Reading Hospital, on the next hearing.

The doctor had conducted autopsy in an under-trial case and is now a prosecution witness in the same case.

In the said case, an accused, Bukhtawar, has been facing trial for killing a person in 1996. The witness was summoned by the court during the last various hearings but he did not turn up before the court.
