Iraqi doctor not yet presented in court


QUETTA, Dec 16: The Chief Justice of Balochistan High Court, Justice Raja Fayyaz Ahmed, has said that the intelligence agencies should fulfil the legal requirements before taking any required person into custody, if he is involved in any case.

“If some one required for investigation he should be taken into custody after completing the legal proceedings and they should not be kidnapped,” Justice Ahmed said.

He made these remarks during the hearing of an application filed by Mrs Ahlam wife of Dr Shuakat Nafay Hikmat for the recovery of her husband, who was taken into custody by the intelligence agencies from his residence on Oct 16.

The division bench of the BHC, had ordered on Dec 12 last that Dr Hikmat should be produced before the court on Dec 16 and notices should be issued to the director general ISI, deputy inspector general police, Quetta, SSP Quetta, deputy attorney general and advocate general of Balochistan.

However, Dr Hikmat was not produced before the learned court on Monday. The Deputy Attorney General K.N Kohli informed the court that the notice was sent to DG ISI through courier service in this connection.

After the deputy attorney general’s statement the hearing of the application was adjourned till Jan 14.

The Chief Justice of BHC on the occasion asked the Secretary Home that he should convene a meeting of concerned intelligence agencies and law enforcement agencies and inform them that in case of arresting the wanted people they should complete the required legal proceedings before taking them into custody.—Staff Correspondent
