KARACHI: Contempt notice in property dispute case

KARACHI, Dec 2: Justice Amir Hani Muslim of the Sindh High Court issued on Monday a showcause notice for contempt to a defendant who rented out a disputed property despite a stay order.

Petitioner Sabiha Alam alleged, through Advocate Dilawar Hussain, that her brother carved out an 850-square-yard plot in North Nazimabad into four portions when the court was seized of a dispute and had ordered status quo in respect of it. He raised construction on it without permission or even bringing it to the knowledge of his three sisters, who were co-sharers of the property. He rented out the premises to four parties on payment of a total amount of Rs2 million and monthly rent running into about Rs8,000.

The allegation was supported by the plaintiff’s sisters, who have been joined as co-defendants. The court asked the defendant brother to show cause on Dec 16 why he should not be tried for contempt of court.

BAIL REFUSED: The Sindh High Court dismissed the bail application of a former bank executive being tried for embezzlement.

The applicant, former senior vice-president of a private bank, submitted that he had unjustly been charged with misappropriation of Rs2 million on a fake transfer letter. He was innocent and had signed the voucher in good faith. There was nothing to link him with the commission of the offence alleged.

Appearing for the state, Deputy Attorney-General Nadeem Azhar Siddiqui submitted that 11 prosecution witnesses had implicated the applicant in the offence before the trial court - the special court for offences in banks. There was also documentary evidence against him and there were reasonable grounds to believe that he was involved in the offence.

case referred to ATC: Justice Shabbir Ahmed of the Sindh High Court, who is also the administrative judge of the anti-terrorism courts for Karachi division, accepted on Monday the challan of four accused, Adeel, Noman, Sohail and Ms Masooma Bano alias Huma, involved in the kidnapping of a 13-year-old boy, Saeed, and referred the case to the ATC-III.

According to the prosecution, the accused kidnapped Saeed on Oct 28 in the police limits of Taimuria. His father, Raees Ahmed, lodged an FIR at Taimuria police station, adds APP.

After two days Saeed returned home and informed police of the place where he was kept by the accused. Police raided the house and arrested Adeel, Noman, Sohail and Ms Masooma Bano.

Accused Sohail is wanted in about two dozen cases of murder, including the murder of two sons of DSP Azizur Rahman.

BAIL GRANTED: A division bench of the Sindh High Court, comprising Justice Shabbir Ahmed and Justice Ataur Rahman, on granted bail on Monday to an accused in a heroin smuggling case against a surety of Rs400,000 and personal bond in the like amount.
