PESHAWAR: Police ordered to complete probe into Nazim’s murder case

PESHAWAR, Nov 23: The court of a judicial magistrate here on Saturday directed the local police to complete investigation into the killing of a union Nazim and submit challan of the case within 14 days.
The presiding officer, Safiullah Khan, disposed of an application filed by Advocate Ishaq Khalil, brother of the slain Nazim, Fayyaz Khalil, requesting the court to issue directives for the arrest of two police officers involved in the murder.
The court observed that, under section 173 of the Criminal Procedure Code, it was binding on the investigation officer to complete investigation in 14 days and submit the report to the court concerned.
The investigation officer, Shahnawaz Khan, appeared before the court and stated that investigation was in progress in the case. He added that the challan would be submitted before the court after completion of the probe.
The court directed him to adhere to the law and submit the challan so that it could be evident whether the two officials had been included in the list of accused persons or not.
The late Fayyaz Khalil, who was Nazim of union council Pishtakhara, was killed on Sept 16 during a protest demonstration by inhabitants of the area against power suspension. His relatives and eyewitnesses had charged two police officers — an assistant superintendent of police, Dar Ali Khattak, and a station house officer, Shakirullah Bangash — with the commission of the offence.
The two officers had filed pre-arrest bail application before a court of additional district and sessions judge, but on Nov 1 they withdrew their application, stating that their counsel had been facing threats due to which he could not appear.
They were taken into custody by the police but, later on, the police claimed that the officials were not arrested and they were only in safe protection.
The applicant contended that the officials were directly charged in the FIR and eyewitnesses were available to testify against them. He stated that it was legally binding on the police to arrest the officials and produce them before a court of law for getting their physical custody.
After the court pronounced its order, Ishaq Khalil told the newsmen that with the submission of the challan of the case it would become clear to them whether the officials were included in the list of the accused.
