KARACHI, Nov 12: A single bench of the Sindh High Court, comprising Justice Mohammed Roshan Essani, repeated on Tuesday non-bailable warrants for the arrest of contemner Major Mohammed Ayaz Toosy (retd) through the provincial home secretary.

The contempt proceedings were initiated by the court on an application moved by Salman Asad, resident of Karachi. The petitioner was a tenant of Major Ayaz Toosy, and civil litigation is pending on increasing rent between the landlord and the tenant.

Mr Salman submitted that the said contemner came with DSP Rasheed Shah on the night between Oct 22-23, threw his household articles on the road and got the house vacated forcibly by his servants.

He approached the SHC against the illegal action. The court issued notice to the respondents, DSP (Homicide) Rasheed Shah and Major Ayaz Toosy, but they failed to appear in the court, and showcause notices were issued to them later.

The DSP appeared in the court on Tuesday, but he could not give any valid explanation for his failure to appear in the court on the previous date. He was placed under detention in the contempt matter but later enlarged on bail on his furnishing surety in the sum of Rs50,000 to the satisfaction of the Nazir of the SHC.

The non-bailable warrants for the arrest of Major Toosy was issued in the same case. However, the contemner did not appear in the court, and the warrant was repeated.

A division bench of the SHC, consisting of Justice Ghulam Rabbani and Justice Syed Ali Aslam Jaffery, adjourned the hearing of a petition of Ms Shahjehan Begum to Nov 22, in which she sought release of her son from illegal police custody.

Shahjehan Begum stated that law-enforcement personnel arrested her son Sheikh Mohammed Rizwan, 23, when they were in search of his brother Sheikh Mohammed Kamran, 26, an activist of the Harkatul Mujahideen.

She alleged that her son had been kept in an unknown place, and she was threatened that her son would not be released until she handed over his brother Kamran. She prayed for the release her son and that she be informed of the whereabouts of the detainee. — PPI
