KARACHI, Nov 5: Advocate-General Raja Qureshi was asked on Tuesday to make detailed submissions on Wednesday on Sindh Democratic Alliance President Imtiaz Ahmad Sheikh’s petition questioning the Election Commission’s rescision of its notification declaring him MPA-elect from PS-11 (Shikarpur-II).
As the petition came up before a division bench of the Sindh High Court, comprising Justice Ghulam Rabbani and Justice Ali Aslam Jaferi, the AG sought to submit a few legal propositions before it to help it adjudicate the petition. The main proposition pertained to the EC’s obligation to notify the election results under section 42 of the Representation of the People Act.
The SDA chief claims that he was declared elected according to results initially compiled by the returning officer and notified by the Election Commission. The RO, however, tabulated a second result and the Election Commission obliged his nearest rival, Agha Tariq of the PPP, with a notification of his election. The notification of the petitioner’s election was withdrawn. He says the EC had no power to revise its notification.
Advocate Abrar Hasan appeared for the petitioner, Advocates Aitzaz Ahsan and Raza Hashmi for Agha Tariq and Deputy Attorney-General Nadeem Azhar Siddiqui for the federal government.
