KARACHI, Oct 16: A division bench of the Sindh High Court, comprising Justice Sabihuddin Ahmed and Justice Amir Hani Muslim, on Wednesday directed the district police officer, Sujawal, and EDO Revenue to appear before the court on Oct 23.

The bench was hearing a petition filed by one Aachar who alleged that Chauhar Jamali police on the instigation of Nazim got his shop vacated.

The petitioner maintained that the dispute was lying adjudication before Supreme Court of Pakistan, owing to a small piece of land in front of Dargah Shah Aqeeq.

The petitioner maintains that Mohammed Ashraf and Kahlifo Umar, with whom he has a dispute over the said land, moved an application with the Nazim of Thatta after which action was taken by the Chuhar Jamali police.

The bench, after perusing the case papers and other documents submitted before the bench by an SI, ordered the DPO, the EDO other police officials to attend the court on Oct 23.

Meanwhile, the same bench also admitted a petitioner Ms Anweri Begum to bail against a surety of Rs 0.1 million in a dacoity case.

The petitioner was earlier produced before the bench on the orders of the court.

Abdul Razzak, husband of petitioner, was killed by some persons at his trucking station in Kalri on March 13 in broad day-light.

Ms Anweri, widow of deceased Abdul Razzak, then filed a petition seeking direction to police to lodge an FIR as per her version implicating three real brothers of deceased and five employees of her husband’s firm “New Christian Goods Transport Company”.

While the dispute over property was going on, her inlaws, brothers of deceased, lodged an FIR with police alleging that she, with her eldest son accompanied by five armed men came to disputed office and forcibly took away rupees 0.5 million in cash and two vehicles worth millions.

SI Mohammed Ismail of Central Investigation Department, appearing before the bench, said the petitioner was arrested on Tuesday by him from near Preedy police station and a five- day remand of the accused/petitioner was obtained from Judicial Magistrate, Malir-II.

The bench perused the affidavits filed by the counsel for petitioner Rana M Shamim and Munawwar Sultana, advocate, and also the memo of arrest of the petitioner/accused.

AAG Abbas Ali submitted that it was a purely civil dispute and petition is not maintainable.

The bench, however, after a detailed hearing held that “it was premature to say that whether criminal proceedings (against petitioner) are justified “.

The bench then admitted her to bail against a surety of Rs100,000.—APP
