HYDERABAD: Registration of case against four cops ordered

HYDERABAD, Oct 1: A division bench of the Sindh High Court, Hyderabad circuit bench, here on Tuesday ordered the registration of a criminal case against an inspector and three sub-inspectors of the investigation police for illegally detaining a man, extorting money, harassing the petitioner and making false statements before the court.

The court said the case against Inspector Mir Mushtaq Talpur, currently posted at the Qasimabad police station, and sub- inspectors, Mehboob Ali Shar, Ali Bux Shar, and Gul Hassan Unnar, would be investigated by an officer not below the rank of DSP and ruled the officials would not be given any field posting till they were acquitted by the trial court concerned.

The bench, comprising Justice Amir Hani Muslim and Justice Maqbool Baqar, observed if the trial court found these policemen guilty, they should compensate the detainee by paying him Rs25,000 each by the sub-inspectors and Rs50,000 by the inspector, in addition to the sentence that might be awarded to them by the trial court.

The order was passed after Sindh AAG Masood A. Noorani submitted the inquiry report of the district police officer, operations, Hyderabad, A.D. Khwaja, regarding the detention of a man, before the court.

On Sept 17, Justice Muslim had directed the DPO, operations, and the DPO, investigation, to hold an inquiry against the police officials of Husri and Hatri police stations in respect of detention of Mohammad Juman Brohi, who, according to applicant Abdul Aleem Brohi, was in police custody for the last three months but was shown arrested on Sept 13.

He had called both the DPOs after the detainee was produced before the court although the police had denied on Sept 10 that he was in police custody.

Irfan Kalhoro had filed the application of Brohi, saying the the SHO of the Hatri police station and investigating officer Talpur had picked up the applicant’s brother, Juman, from his house on May 28. He said Juman was also beaten up by the police.

He had pointed out the detainee had neither been shown arrested nor his remand been obtained from any court to date.
