HYDERABAD: SHC issues notices in forgery case

HYDERABAD, July 25: The Sindh High Court, Hyderabad circuit bench, here on Thursday issued notices to the SHO, Hala police station, and the assistant director, district elementary education officer (male), Hala.

The notices were issued on a constitutional petition of two mosque school teachers, Dad Mohammad Leghari and Saeen Bux Leghari, praying the court to register a case of forgery against the assistant director, district elementary education officer, Allah Jurio Unnar.

Advocate Ayaz Latif Palijo represented the petitioners.

The petitioners claimed that after taking over as assistant director in 1994, Unnar started committing forgeries in his official capacity.

They charged that Unnar made forged entries, showed fake degrees and qualification in the names of petitioners. They claimed that without the petitioners’ knowledge, he collected lakhs of rupees as increments.

The petitioners claimed that an amount of Rs13,778,100 was defrauded on behalf of 300 teachers.

They said forged bills were made and difference of amount was claimed in the name of several teachers.

They alleged that in collusion with clerk Ghulam Mustafa Mashori and Khair Mohammad Dahiri, Unnar embezzled lakhs of rupees of the government and teachers.

The petitioners added that to conceal the fraud, original papers of the service books were destroyed and replaced and forged signatures of former district coordinator, the late Mohammad Umer Memon, were used to cover up the crime.

They said the respondent had also misappropriated GP fund of teachers and despite several written and verbal complaints by majority of teachers, service books or treasury records were not shown to them.

They said when some teachers got additional qualification, the treasury refused to pay any difference as the same had already been claimed and defrauded by the aforementioned accused.

The petitioners said when one of them came to know about this fraud in August 2000, he and other affected colleagues moved applications to their department for inquiry and action against these officials. They added that the assistant director, directorate of primary education, issued a letter for inquiry on Nov 10, 2000, but no action was taken and no case of financial malpractice, involving millions of rupees, was lodged.

They said when they filed an application before the provincial ombudsman, they were advised to seek redress through the anti-corruption establishment (ACE).

They said that because of their protest, Unnar got annoyed and on July 15, 2002, he along with clerk Ghulam Mustafa Mashori and Khair Mohammad Dahri, beat them and warned them that if they continued their complaints they would be kidnapped and killed.

The petitioners said they immediately asked the SHO of Hala to register an FIR but to no avail.

They prayed the court to direct the SHO and circle officer, ACE, to investigate the forgery committed by Unnar.

They also prayed that the DPO be directed to recover the defrauded amount and original service books of petitioners and they should be provided protection.
