KARACHI: High Court restrains KUTS from protest

KARACHI, July 11: Justice Ataur Rahman of the Sindh High Court has ordered the parties to maintain status quo until the next date of hearing when a petition of Karachi University, apprehending that the defendants “may proceed on strike and may boycott the forthcoming examination” came up on Thursday.

When the matter came up, Nadeem Azhar Siddiqui, advocate, representing the plaintiff, placed on record copy of a newspaper report in which it was alleged that the defendant No 1, the Karachi University Teachers Society (KUTS, had decided to launch a protest movement against the University administration.

The Karachi University Officers Welfare Association, Karachi University Employees Welfare Association and Directorate of Social Welfare, government of Sindh, have been made defendants in the matter.

The counsel submitted that if the defendant No 1 was not restrained, the plaintiff would suffer irreparable loss due to boycott of classes as proposed by the defendant No 1.

It was the contention of the plaintiff that the defendants’ actions were in violation of the Civil Servants Conduct rules.

In view of the above circumstances, presented by the plaintiff, Justice Rahman directed the parties to maintain status quo till the next date of hearing on July 16.

The defendant No 1, KUTS, has maintained that KU employees are governed by the University code and as such not by the Sindh Civil Servants Conduct Rules, 1973, which have not been adopted by the University Syndicate.

tariq road: A bench of the High Court of Sindh, comprising Justice Ataur Rahman, issued on Thursday pre-admission notice to the state in a petition challenging declaration of Tariq Road as one way, adds APP.

The petition was filed by hundreds of shopkeepers having shops in commercial complexes on and off Tariq Road.

Khawaja Sharful Islam, counsel for the petitioners, submitted that the impugned order under which Tariq Road was declared one way had badly affected their business.

After initial hearing, the court issued notice to the respondent.

HEARING ADJOURNED: The Sindh High Court put off on Thursday the hearing of a constitutional petition challenging the detention of Fattani brothers under MPO to July 15.

When the petition, filed by Najma Fattani, came up for hearing before a division bench of the High Court of Sindh, comprising Justice Sabihuddin Ahmed and Justice Zia Pervez, an additional advocate-general Sindh sought time for submitting the material which formed the basis for passing an order of detention.

A PDSP, Aslam, appeared for police and submitted that he needed time to collect the material from the town police officer.

Relatives of the detainees were present in the court and they requested that justice be done to the family as the mother of Mehmood Fattani, Afzal and Yasin Fattani is seriously ill.

Qazi Mohammed Bashir and Anila Siddiq, holding brief for Khawaja Naveed, advocate, submitted that the court orders were not being given due importance.

The court ordered that if further adjournment was sought on July 15, then the officials would have to deposit Rs,5000 a day a person with the Nazir of the court.

RIBA: The constitution provides a mode for Islamization of all organs of the state, including legislature, executive and judiciary, which can exercise power under article 227 (2), chapter 3-A, and article 2-A of the constitution.

This was submitted in a petition filed with the High Court of Sindh by a local lawyer challenging Riba.

The petition is likely to come up for hearing on July 17.
