KARACHI: SHC orders attachment of another killer bus

KARACHI, April 3: Justice Sarmad Jalal Osmany of the Sindh High Court has ordered impounding of a bus involved in a fatal accident in which a lawyer was killed.
The order was passed in a suit for recovery of Rs35,00,000 under the provisions of Fatal Accidents Act, 1855. It was filed by Nasir Masood advocate for Shahina Abid, widow of Mohammad Abid Khan who died after his motorcycle was hit by the bus in Gulberg area on April 10, 2001.
On behalf of the plaintiff, counsel Aamir Maqsood filed an application praying attachment of the bus (JA-5987), because the complainant would be left with no remedy if the vehicle was sold.
Justice Osmany, allowing the application, ordered the Samanabad SHO to impound the bus and place it before the court. The motor registration wing of the Excise and Taxation Department was also directed not to transfer the vehicle till further orders.
A criminal case was registered on April 10, 2001, against defendant No. 3 — the driver — under section 320, PPC, in Samanabad police station. The driver was booked for rash and negligent driving and the bus was impounded. Later, however, the bus was handed over to the owner on his application for superdaginama.
bail granted: An activist of the Muttahida Qaumi Movement was granted bail by a division bench of the Sindh High Court in three different cases in which he was accused of being involved in attacking government property.
The bench comprised Justice Ata-ur-Rahman and Justice Sarmad Jalal Osmani.
Ajmal Siddiqui alias Ajmal Pahari was accused of bombing the Sindh secretariat, Tughlaq House, and office of the FIA in 1998.
The bench, after hearing his counsel Khawaja Naveed advocate, admitted him to bail in all the three cases against a solvent surety of Rs0.1 million each.
ALLIANCE MOTORS CASE: In a case against four directors of the Alliance Motors for transacting illegal banking business and collecting over Rs5 billion from the public, the State Bank counsel sought time to submit some supporting documents.
It is the case of the SBP that as directors of the Alliance Motors, Pir Asghar Ali Qureshi, Hamid Ali Qureshi, Mohammad Ibrahim and Mohammad Yunus, collected money from the public offering them higher rate of profit.
The SBP filed private complaints against the company and the directors on account of violation of banking business rules. The High Court issued warrants against them, but Pir Asghar and Hamid Ali Qureshi absconded. The case proceeded against the other accused.
During the proceeding, one of the accused, Mohammad Ibrahim, also absconded. Now with great effort and in pursuant to the proclamation issued by the High Court, Pir Asghar Ali and Hamid Ali Qureshi were arrested by the FIA and produced before the court.
They filed a bail application which was fixed for April 3 before Justice Zia Pervez. The case was adjourned to April 8 after the SBP counsel sought time.
Imran Ahmed advocate appeared on behalf of Hamid Ali and Asghar Ali Qureshi.
Notice issued: A Sindh High Court bench, comprising Justice Wahid Bux Brohi, on Wednesday put the state on notice for April 11 in a case of alleged illegal confinement by police, adds APP.
The complainant, Habib Ahmed, alleged that officials of the Mubina Town police station raided his house and took his brother and son into custody.
The detainees were being kept in a private cell instead of police lockup, he alleged.
The court issued notice to the advocate-general, Sindh, and other respondents for April 11.
