HYDERABAD, Jan 23: The Anti-Terrorism Court, Judge Abdul Ghafoor Memon, of Hyderabad has directed the First Extra Joint Civil Judge, Ms Shagufta Kaka, to appear before the court and record her statement in a kidnapping-for-ransom case.

The order was passed on an application, filed by special public prosecutor, Atta-ur-Rehman Memon, who requested the court to call the magistrate in the matter.

The magistrate has been asked to appear on Thursday and testify.

On Tuesday, two former SHOs of the Bhittai Nagar police station, Mahboob Sipyo and Salim Rind, deposed before the court.

Mr Sipyo claimed that he took over the charge on Jan 8 and lodged the FIR of the kidnapping case.

The next day he went to the place of offence and prepared mushirnama along with ASI Jan Muhammad and Constable Safdar. He said that the statement of hostage, Airaj Ameen, was also recorded under section 161 Cr.PC. Thereafter, he recalled that he proceeded on long leave. He was replaced by Salim Rind who took over the charge on March 7 and on March 8 he received police papers of the case.

He maintained that he recorded the statements of witnesses, M. Ameen Khaskheli, and his brother, M. Alam Khaskheli.

He said that on March 3 the car, used in the offence, was recovered near the State Life Colony. He added that on May 5 he went to the CIA Centre where he found the accused, who were being interrogated in another offence lodged with the B-section police station.

The defence counsels, Irfan Kalhoro and A. Bachayo Soomro, raised objection when he reproduced the whole statement of Mithal Khaskheli. The objection was brought on record.

He informed the court that later he charge-sheeted all the accused in the case.

TWO HELD: The Gulshan-e-Hali police arrested two alleged outlaws — Yusuf Manda and Nasir — and recovered weapons from them, police said on Wednesday.

They were said to be possessing a 7mm, a repeater, and three TT pistols.

SHO Aijaz Tareen claimed that a campaign had been going on for the recovery of illicit weapons and it was in this connection that the encounter took place. The co-accused, Habib Bengali, Raheem Makrani, and Shahid Abbasi fled from the scene when police raided a place near the railway workshop. He added that a brief exchange of fire took place. He said that Shahid Abbasi was armed with a double barrel gun. Four separate cases have been lodged against them at the police station. They were also required in cases at the Phuleli and Tando Yousuf police stations.

Police had also arrested an activist of the Muttahida Quami Movement, Majeed.

A source said that he was however released after former MPA of the party Syed Afzal Shah approached police and clarified the position of Majeed.

Sources said that the police had picked up a unit in charge of the MQM, Anees, and his brother, Qadeer. Their arrests have been brought on record.

SHC: A division bench of the Sindh High Court, Hyderabad circuit, on Wednesday directed the Kotri police not to harass a detenue, Ghulam Mohammad, who was found in illegal detention during a raid at the Kotri police line building on Tuesday.

Moeenuddin, father of the detenue, filed a criminal miscellaneous application before the court, praying for the recovery of his son.

The court appointed Hidayatullah, a court official, to visit the place and ascertain facts. The official went there and found that the detenue was being confined in the building. A guard was posted there. No entry was made at the police post or station concerned.

The police produced the detenue before the court.

The petitioner requested the court to direct the police not to harass him.

The court passed the order accordingly and released the detenue.

The Additional AG, Sindh, Masood A. Noorani, represented the accused.
