SC issues notice to FST member

ISLAMABAD, Jan 17: The Supreme Court on Thursday issued notice to a member of the Federal Services Tribunal (FST) who allegedly decided a case against a Wapda official.

The counsel for Syed Yaqoob Shah, a Wapda employee said that Mohammad Ayub Khan, member FST had authored the judgment against him because the petitioner had lodged a complaint against his son Inayatullah Khan, a brick-kiln owner who had been reversing /tempering with the meter and thus committing power theft.

The appellant, Mr Shah, stated that military authorities conducted a raid on the brick kiln which resulted in the registration of a criminal case against the member FST, his son and their clerk munshee.

The appellant said member FST in connivance with Wapda got a false case registered against him with regard to the same electricity meter.

He stated that during the hearing of the case, petitioner pointed out to the FST members of the tribunal about this and said that case may be heard by a bench of which Mohammad Ayub Khan was not a member.

The petitioner said that as far as admission attributed to him in the judgment was concerned, it was concocted and the petitioner through an affidavit categorically denied existence of such an admission.

The FST, however, without taking it into consideration, decided the case against the petitioner in a highly illegal manner. Because of this act of Mohammad Ayub Khan, injustice had been committed against the petitioner, while the petitioner was given an assurance that justice would be done to him.

The SC bench comprising Justice Iftikhar Mohammad Chaudhry, Justice Hamid Ali Mirza and Justice Tanvir Ahmad Khan issued notice to the respondents as well as Mohammad Ayub Khan, member FST to furnish comments, if any, in respect to the allegations imputed against him because there was likelihood of passing of remarks, if need be, against him.
