HYDERABAD: SHC summons SHO, AAG

HYDERABAD, Dec 31: Justice Ghulam Rabbani of Sindh High Court, Hyderabad circuit, here on Monday issued notices to SHO Bhitai Nagar police and Additional AG Sindh, Masood A. Noorani, for Jan 2 on a constitutional petition, praying for registration of FIR against two SHOs, an ASI and two constables for killing an innocent man in a fake encounter.

The petition was filed by Mohammad Yousaf Palari through Faiz Mohammad Qureshi advocate.

Those who have been cited as respondents include Arshad Leghari, SHO Qasimabad police, Hamir Bhangwar, SHO Hatri police, Raza Mari, ASI, Aijaz, Mehboob, both police constables, Taqi Laskani, sub-inspector, DSP Qasimabad, SHO Bhitai Nagar police and Dr Madad Ali alias Gulab Laksani,.

The petitioner is father of Roshan Palari who was killed in an alleged police encounter on Dec 24.

He said that Dr Laskani had purchased a piece of land adjacent to the village of the petitioner, where he and other villagers intended to construct a mosque and a guest house but Laskani objected to it and became hostile towards him and his sons.

He said that Dr Laksani had threatened him not to construct mosque or guest house at the said place adding if they did so, they would not be spared.

He added that on Dec 23 while he was on his way to his house from the cattle pen, he was attacked by the gunmen of Dr Laskani but he escaped unhurt.

He said that Dr Laskani was cousin of sub-inspector Taqi Laskani who had close connections with other respondent police officials.

He said that on Dec 24 the respondent police officials came at the bungalow of Nadir Wakio in Qasimabad where his son lived and had been grown up. Since no male member was present except Roshan Palari, the womenfolk called Palari who rushed to the main gate.

The police officials took out their weapons and within the sight of inhabitants of the area, including Sain Dino s/o Soomar Palari, Saleh s/o Waroo Sabroo and others, fired on Roshan who suffered bullet injuries and died, the petitioner said.

His body was taken to the civil hospital where the police officials told the doctors that he died in an encounter with police and was a notorious dacoit.

The petitioner charged that the respondents had committed an offence by killing an innocent person at the behest of Dr Laskani.

The police refused to lodge his case at Qasimabad police station therefore he filed this petition.

He claimed that senior police officers were protecting the other policemen.

He prayed the court to direct the SHO Bhitai Nagar police station to lodge the FIR against seven police officials including SHOs Arshad Leghari and Hamir Bhangwar, sub inspector Taqi Laksani, ASI Aijaz and two police constables.
