KARACHI, Dec 28: The Anti-Terrorist Court (ATC) No 4, presided over by Khan Pervez Chang, has issued notice for Jan 9 to SHO Gadap in a case filed by one Abbas Ali against three accused on murder of a police head-constable and injuries to a constable.
The complainant has made Pawan Kumar, Ganga Ram alias Gangu, Madan Lal and SHO of Gadap as respondents.
Complainant Abbas Ali, constable of Gadap along with a head constable was on patrol duty on a motorcycle on July 30, 2000.
They saw a suspected Toyota car, and chased it on their bike and asked the driver to stop by road-side about 5 to 6 km away from the Toll Plaza, somewhere near Quetta Darbar Hotel.
The driver of the car, hit their motorcycle, throwing them on the road and sped away.
The complainant said that the respondents while fleeing threatened them saying this was a lesson to them for coming in their way.
In the mean time an ambulance from Edhi Centre came and picked the injured police officials to Jinnah Hospital.
The HC Ghamgheen Hussian later died in the JPMC after remaining unconscious for eight days.
The complainant lodged an FIR, but the police did not properly investigate the matter and applied wrong sections of the law and no culprit was arrested.
The complainant later came to know that the Toyota Car, which the respondents were driving was a stolen vehicle and an FIR in respect of theft had already been lodged by its owner at the Gulberg Police Station.
The complainant later filed an application to District Judge Malir and the judge ordered that his court had no jurisdiction to entertain the complaint and the same be returned for presenting before the court having jurisdiction in the matter.
The complainant thus filed the application before the Administrative Judge of ATC Justice Shabbir Ahmed (Judge of Sindh High Court), who after hearing admitted the case sent it to the ATC Judge for a further trial.
On the hearing of the case, the ATC-4 Judge issued notices to the SHO for January 9 to file his comments.—APP
