KARACHI, Dec 28: Justice Wahid Bux Brohi of the Sindh High Court ordered the arrest of a foreign vessel M V ECO-Ekram on a suit filed by Almina for the recovery of Rs 2 million repair charges of the ship.
However, the bench observed the vessel be released on furnishing security of the suit amount for satisfaction of Nazir of the court.
The plaintiff moved the SHC through counsel Agha Faquir Muhammad against the owners of the ship M V ECO Ekram as he had hired plaintiff’s services for its repair but after complete repairs he did not clear the dues.
Meanwhile, Justice Shabbir Ahmed of the SHC dismissed a claim of shipping agent Bulk Trade for the recovery of Rs18.844 million from a Turkish ship CEMRE-II.
Earlier, the plaintiff had taken detention order of the said vessel and now filed a suit with the SHC and claimed he spent the said money on different heads, including port charges etc.
The court after hearing the contention of plaintiff’s counsel Agha Faquir Muhammad excluded the said claim of shipping agents.
PLEA ADJOURNED: Justice Ghulam Nabi Soomro of the Sindh High Court on Friday adjourned the hearing till Jan 3 of a revision application filed by DSP CIA Saadullah Bangash involved in the murder case of one Abdus Sattar Baloch who was killed in CIA custody.
The applicant filed a criminal revision application against the impugned order of the additional district and session judge south (where the case of death in custody is pending trial) as he did not accept the second charge-sheet on the ground that it had already taken cognizance of the case.
When the matter came up for hearing, Justice Soomro asked applicant’s counsel Farid Ahmed Dayo to cite any example that court is bound to accept the challan filed by the police. Applicant’s counsel sought time to cite examples.
The murder case was registered on the directives of SHC at the Kalakot PS and in the FIR, DSP Saadullah Bangash, SI Ghulam Ismail and others were nominated.
After investigations, the police submitted challan in trial court against all the accused but later the police submitted an amended challan and excluded the name of DSP from the list of the accused under Section 173 Cr.PC.
However, Judge Farooq Channa of trial court rejected second challan as police after submitting the first challan did not exercise their powers under section 173 Cr PC.
According to prosecution, accused Saadullah Bangash with other CIA police officials nabbed Abdus Sattar Balouch from his house in Kalakot and later killed him.—PPI
