DERA ISMAIL KHAN, Dec 5: The Peshawar High Court was told on Wednesday that if Jamiat Ulema Islam (F) chief Maulana Fazlur Rehman was ready to submit a bond that he will obey the government and not cause any disorder, the NWFP government would not extend his detention after Thursday.

Deputy Advocate General Shaukat Hayat Khakwani said that if Maulana Rehman was not ready to make such a commitment, the Home office would resist his release even on bonds.

The PHC, Dera Ismail Khan bench, comprising Justice Qazi Ehsanullah Qureshi and Justice Ejaz Afzal, was hearing a writ petition challenging detention of the JUI(F) chief.

The court had inquired whether the government intended to extend the period of detention, which was ending on Thursday. The deputy advocate general was given time to contact the Home Office at Peshawar in this regard.

When, Justice Ejaz asked whether the government had any evidence that disorder would be created if Fazlur Rehman was released, the deputy advocate general presented some newspapers reports stating that a movement against the government was proposed after Eid.

The court rejected the plea saying reports from agencies could be produced as evidence.

Mr Khakwani pleaded that the PHC had rejected the writ of Jamaat-i-Islami chief Qazi Hussain Ahmad, which was of the same nature. The court observed that the writs were different in nature. The court said that several cases under 3-MPO were brought for decision and a number of them were decided.

The verdict will be announced on Thursday.

Zahid Yousuf advocate appeared for District Nazim Latifullah Khan Alizai. Salahuddin Khan Gandapur and Shujaullah Khan Gandapur appeared for Fazlur Rehman.
