LAHORE, Nov 21: The Lahore High Court upheld on Wednesday the punishment of amputation of a forearm awarded by a sessions court under the Islamic law of retribution.
The appellant had fired at a video shop owner when he demanded a rent payment for a video film and a TV set. The owner’s forearm had to be severed as a result of the injury. The trial court sentenced the accused to undergo the same ordeal and also pay a fine of Rs100,000 to the victim under Section 324 of the Pakistan Penal Code.
Dismissing the convict’s appeal, Justice Khwaja Muhammad Sharif observed that the victim carried the tell-tale evidence of the offence and that the trial court had justly punished the offender.
NOTICE TO JAIL CHIEF: Justice Khalilur Rahman Ramday asked the Sargodha jail superintendent on Wednesday to show cause why he should not be punished for keeping a person in custody in disregard of a high court judgment.
A prisoner had complained that he was sentenced to three years in jail for attempted rape under the Offence of Zina Ordinance. Under a recent high court decision, he was entitled to remissions announced from time to time. Yet the jail superintendent was not prepared to let him benefit from the remissions.
The superintendent and a representative of the Prisons Department appeared on Wednesday but failed to satisfy the court about their failure to follow its ruling. Justice Ramday issued a show cause notice to the jail official.
