ISLAMABAD, Nov 19: Secretariats of defunct legislative bodies have been vested with certain administrative and financial powers through the Chief Executive Order No. 11 of 2001.
The order reads: Whereas the National Assembly, the Senate and provincial assemblies stand dissolved in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, read with the Proclamation of Emergency (Amendment) Order, 2001 (CE’s Order No. 2 of 2001);
And whereas it is expedient to provide for vesting and exercise of certain administrative and financial powers and performance of certain functions relating to the secretariats of the dissolved legislative bodies for the purposes hereinafter appearing.
Now, therefore, in pursuance of the Proclamation of Emergency of the fourteenth day of October 1999 and Provincial Constitution Order No. 1 of 1999, and in exercise of all powers enabling him in that behalf, the Chief Executive of the Islamic Republic of Pakistan is pleased to promulgate the following Order.
Short title, extent and commencement:
(1) This Order may be called the Secretariats of the Dissolved Legislative Bodies (Exercise of Administrative and Financial Powers) Order, 2001.
(2) It extends to the whole of Pakistan.
(3) It shall come into force at one and shall remain in force during the period the legislative bodies remain defunct. Definitions according to the order are:
“Chairman” means the chairman and includes deputy chairman of the defunct Senate;
“Constitution” means the Constitution of the Islamic Republic of Pakistan 1973;
“Finance Committee” means a defunct committee of a legislative body;
“Legislative body” means the defunct National Assembly, the Senate, or a provincial assembly;
“Secretariat” means the secretariat of a legislative body;
“Speaker” means the speaker and includes deputy speaker of the defunct National Assembly and a provincial assembly.
Vesting of certain powers and function: Notwithstanding anything contained in the Constitution, any law, rule, order or notification, all administrative and financial powers and functions which immediately before the twelfth day of October 1999, vested in, or were exercised or performed, on the advice of a Finance Committee, by the Chairman or, as the case may be, the Speaker of a legislative body, in respect of the secretariat and the persons serving therein, shall in case of the secretariat of the defunct National Assembly or the Senate, vest in, and be exercised and performed by, the President or any authority or officer designated by him, and in case of secretariat of a defunct provincial assembly, vest in, and be exercisable and performed by, the governor or any authority or officer designated by him.—NNI
