HYDERABAD, Nov 14: Justice Wahid Bux Brohi of the Sindh High Court Hyderabad circuit bench has issued notices to the SSP of Hyderabad, the DSP of Matiari, the SHO of Shahdadpur police station and others on a constitutional petition alleging harassment by the police.

The notices were issued for Nov 19.

The petitioner, Mukhtiar Ali Khaskheli, claimed that his wife, Nazir Begum, had re-married a private respondent, Manzoor Ali Khawar, a resident of Matiari but she filed a suit for dissolution of the marriage before the civil court and an ex-parte judgment was passed, dissolving the marriage between the parties by way of Khula .

He said that Manzoor Ali, a servant of the DSP of Matiari, Manzoor Khatian, started creating hurdles and problems due to the influence of the DSP in way of the petitioner and his family in the wake of judgment.

He said that Manzoor Ali managed to lodge an FIR against the petitioner and his family members at the police station of Shahdadpur under the Hudood Ordinance, accusing the petitioner of kidnapping Nazir Begum.

He informed the court that the dissolution of marriage through a court order took place on March 29 while the FIR against the petitioner was lodged on April 19 under influence of the DSP, adding that the matter did not end here as another FIR under section 401 PPC was lodged against him.

He said that his wife had also filed an affidavit before the concerned magistrate and also given a publication in newspapers, mentioning therein that she had married the petitioner of her own free will.

He said that he and his family members had approached the authorities for redressal of their grievances about false allegations but to no avail keeping in view the fact that there was no criminal record or even a single complaint pending against him.

He said that if the legal cover was not provided to them then the police would keep implicating them in false cases.

The petitioner accused the Matiari DSP, who was posted in the same area, of extending threats of dire consequences and implication in false criminal cases.

He alleged that the DSP had threatened that he would not spare the petitioner, his wife and other relatives.

He prayed the court to restrain respondents from causing harassment and humiliation to the petitioner and his family as well as interfering in their personal affairs.

He requested the court to direct the respondents not to issue threats of dire consequences and not to lodge false cases against petitioner’s family.
