KARACHI, Oct 30: A bench of the Sindh High Court, on Tuesday, set aside conviction and sentence of an appellant policeman in a bribery case.
The bench comprised Justice S.A. Rabbani.
Appellant Muhammad Razzak, represented by Munawar Malik, advocate, was convicted by a special anti-corruption judge for the offence under 161 PPC read with 5(2) of the Prevention of Corruption Act.
As a traffic constable, he had allegedly demanded illegal gratification. He was to undergo eight months’ RI and a fine of Rs2,000.
This was called in question by the appellant.
While allowing his appeal, the court held that the prosecution had failed to prove guilt beyond any shadow of doubt.
SERVICE MATTER: A division bench of the SHC put the Advocate General Sindh on notice for Nov 6, when the petition pertaining to seniority of six government officials came up on Wednesday.
The bench comprising Justice Sabihuddin Ahmed and Justice Ali Aslam Jaferi passed the order when the petition of Farhan Junejo and five other officers of the District Management Group came up.
Their grievance is that their names were placed in the 1996 seniority list, as per their seniority. But in the list issued in the year 2000, the same had been disturbed. They objected to it.
Instead of taking their objection into account, a meeting of the provincial selection committee has been scheduled for Wednesday to finalize the list in question, they maintained.
SENTENCE MODIFIED: Another SHC division bench modified the sentence and conviction of three convicts in an arms-related matter. The case against them was registered under Section 13 of Pakistan Arms Ordinance.
The bench comprised Justice S.A. Rabbani and Justice Moosa K. Leghari.
Khwaja Naveed Ahmed, appearing for the appellants, submitted that his clients were not involved in any crime and they were implicated in the case due to their affiliation with the MQM.
Appellants Mohammad Aleem alias Tension, Arif Ali and Tahir Ali were convicted by the STA court of former district South, for allegedly trying to hide arms and ammunition in the Clifton beach area. Two Kalashnikovs were recovered from Aleem and one each from the co-accused, besides magazines and live bullets.
They were given five years and a fine of Rs5,000 each. The bench reduced the term to three years and set aside the fine.
