KARACHI, Oct 26: The Sindh High Court restrained on Friday the accountability court-I from announcing judgment in three different references pertaining to bank loan default, until Nov 8.
A division bench, consisting of Justice Sabihuddin Ahmed and Justice S. Ali Aslam Jafri, restrained Judge Rehmat Husain Jafri, who heads the accountability court-I, when the petition filed by Zakaria Ghani and Yousuf Dada of Zakaria Group of Companies against the National Accountability Bureau, Governor of State Bank of Pakistan and National Bank of Pakistan and other respondents came up for hearing.
The petitioners, represented by counsel Abdul Hafeez Lakho, maintained that they obtained loan from different financial institutions and now were in the process of rescheduling of the same, thus the default was out of jurisdiction of trial court/accountability court.
According to three references, the applicants/accused obtained loan facility of Rs836.17 million, Rs124.0m and Rs416.54m for three companies, namely, Noori Textile Mills, Hyderabad Electronics Limited and Saif Nadeem Kawasaki Motors.
NARCOTICS: A woman who had been convicted of smuggling heroin was refused bail by a division bench of the Sindh High Court.
Parveen Begum was arrested by the Gulzar-i-Hijri police with 1.5 kg heroin in her possession.
The bench comprised Justice Ghulam Rabbani and Justice Mohammed Ashraf Leghari.
Earlier, her bail application was also rejected by the special court (Control of Narcotic Substance).
BUILDERS: Another division bench of the SHC, comprising Justice Sabihuddin Ahmed and Justice Ali Aslam Jaferi, granted bail to two builders in the sum of Rs500,000 each with the direction to cooperate with the NAB authorities, who had instituted a case of acquiring government property allegedly through fraudulent means.
Applicants Abdul Qadir and Mohammed Hanif, who were arrested by the Regional Accountability Bureau on Oct 16, were represented by Khalid Anwar, who contended that allegations against his clients were not true. He also claimed that the prosecution had failed to provide reasons for arrest and detention of his clients.
The prosecution maintains that the applicants had acquired valuable government property with the connivance of government officials.
PPO: The same bench also put the Director-General of Pakistan Post Office on notice for Nov 13 in a contempt of court application moved by Majid Arain.
Nadeem Azhar, appearing for the applicant, submitted before the court that the alleged contemnor had violated an order of the SHC passed on Aug 17 whereby the contract awarded to the Shaheen Express services was ordered to be re- called.
