HYDERABAD, Oct 21: The Cantonment Police have shown leniency while registering a case against two suspended police officials of Nasarpur Police Station by not incorporating certain provisions of Anti Terrorism Act and Arms Ordinance.

The Cantonment Police late Thursday night had lodged the case on the complaint of a Sub-Inspector of ACE, Bashir Shah, under Sections 324, 353 and 34 PPC against Sub-Inspector Habibullah Chand and Assistant Sub-Inspector Aijaz Deeshak.

They were remanded in police custody for four days by Judicial Magistrate-1 of Hyderabad on Friday.

The two suspended police officers had resorted to firing in the courtroom of the Fourth Additional District Judge, Abdul Rasool Memon, when their application for bail before arrest was rejected by the Special Judge of Anti Corruption (provincial).

The police have lodged the case for attempt to murder, obstruction in official discharge of duty, of common intention. Legal experts opined that provisions of 13-D and 7-A and 6-A of Anti Terrorism Act (ATA) 1997 should have been included in the FIR, but the same were not included in the criminal case for reasons best known to the police.

The policemen were found in possession of two pistols which a former police official claimed should have been returned to the police department when the two police officials were placed under suspension.

Even if the pistols were licensed, the policemen were not supposed to carry them when they appeared in the court.

Given the nature of the incident, i.e. firing in the courtroom in which the Additional District Judge and the court staff had miraculously escaped unhurt, the policemen should have been dealt with strictly in accordance with law.
