PESHAWAR: Presence of ADPJ in court challenged

Bureau Report

PESHAWAR, Oct 6: Counsel for an accused in an accountability case on Saturday challenged the appearance of additional deputy prosecutor general before the accountability court, stating that the said post does not exist.

Advocate Babar Awan appeared for the accused, Mohammad Ali Shah, a land acquisition collector arrested in connection with the Ghazi Barotha Hydel Power Project land scam and argued that the additional deputy prosecutor general, Haider Ali should justify under which law he had been appearing before the court.

The court headed by Syed Yahya Zahid Gillani also inquired from the ADPG under which law he had been appearing.

The court has now asked the Regional Accountability Bureau to put forward legal grounds under which an ADPJ could appear before the court.

Mr Awan stated that the said post was not mentioned in any of the law and thus the prosecutor had no authority to appear before the court.

He also referred to the NAB Ordinance, arguing that the post of prosecutor general was there but there was no mention of ADPJ.
