PESHAWAR, April 24: District and Sessions Judge Hayat Ali Shah on Thursday issued a show cause notice to the general manager and two other officials of House Building Finance Corporation for detaining an 80-year-old man.

The court asked the officials under what authority they had detained the man.

A habeas corpus petition was filed on behalf of Syed Ali, son of Qalander, resident of Surezai Payan, stating that the petitioner had been kept in illegal detention by the HBFC since April 22.

The court fixed April 26 for the next hearing and directed the general manager, district manager and recovery inspector of the HBFC and Peshawar Tehsildar to submit their reply to the notice.

The petitioner stated that he had disinherited his son, late Hazrat Gul,  as he had deceived various persons and he had got nothing to do with the acts of his son.  

He claimed that his son had acquired loan from the HBFC in the name of  the petitioner and in the HBFC official concerned was also allegedly involved.

The petitioner stated that he had neither signed any documents nor acquired any loan from the HBFC. He stated that all of a sudden the HBFC started demanding return of the loan about which he had no knowledge.

The petitioner claimed that the HBFC had no authority to detain a person and his detention was illegal.
