HYDERABAD, April 21: Justice S. Ahmed Sarwana of the Sindh High Court, Hyderabad circuit bench, on Monday ordered registration of an FIR against six police officials of the Matli police for trespassing and abusing members of a family.
When the state counsel, Anwar Ansari, contested the maintainability of the petition in view of the amendments to the Criminal Procedure Code and that the matter should be heard by the sessions judge, Justice Sarwana observed that the Sindh High Court had got concurrent jurisdiction in the matter that the FIR should be lodged and if the complainants themselves were found guilty then action should be taken against them.
The order was passed on a constitutional petition filed by Mohammad Iqbal Khoso and Haider Ali Khoso through Advocate Ayaz Latif Palejo.
The petitioners cited the SHO, Matli police station, and the district police officer, Operations and Investigation, Badin, as respondents.
The petitioners said that on Feb 18, In charge (investigation) Manak Leghari, ASI Qamar Zaman Khoso, Constables Ahmed Talpur, Ali Dino Sahto, Din Mohammad Khaskheli, Riaz Rustamani and others surrounded the houses of the petitioners and their relative, Manzoor Khoso, in the Parro Khoso village.
The police officials trespassed into the house, humiliating, abusing and beating the inmates and forcing Manzoor to point out Sabir Khoso’s house.
The petitioners said that, in the meantime, other villagers arrived there and petitioner-1, Mohammad Iqbal Khoso, asked them to leave Manzoor alone and not to insult the villagers. The policemen became annoyed and hit him, and took jewellry and Rs11,000.
The petitioners said that the police kidnapped Azam Ali, 11.
The petitioners prayed the court to direct the SHO, Matli police station, and the DPO, operations and investigation, of Badin to register an FIR against the assailants in respect of the offences made out from the facts.
He said that the in charge, investigation, should be held responsible for his illegal act of extortion and robbery and the petitioners should be given compensation.
The state counsel said that the petition was not maintainable in the light of the recent amendments in the Criminal Procedure Code; therefore, the matter should be referred to the sessions judge.
The court told the counsel that the Sindh High Court has got concurrent jurisdiction in the matter and if the petitioners were found guilty then they should be booked.
COUNCILLOR INJURED: A councillor of union council-8, Shane Illahi, was seriously injured in an armed robbery in Sehwani Mohalla, Faqir ka Pir, on Monday.
A group of four unidentified armed bandits barged into the house of Shane Illahi, who is associated with the construction business and owns a shop in the same area.
The bandits held the inmates hostage at gunpoint and deprived them of their jewellry. Mr Shane was not present in the house at the time. But as soon as he arrived, the bandits opened fire on him injuring him.
Later, he was taken to the Civil Hospital. He has been operated upon and his condition is stated to be out of danger.
His brother, Mohammad Ashfaque, has lodged a case with the City police station.
