KARACHI, Dec 1: The Sindh High Court has put the advocate-general Sindh and the SSP Malir on notice for Dec 6 in a murder case.

The petitioners, Mohammed Siddique and Mohammed Yameen, have filed a constitutional petition through their counsel, Nehal Hashmi.

They claimed that their mother was murdered on June 15 at about 9:45 hours. The incident was reported to police by Mohammed Ismail, who was not related to the petitioners family, and on his report an FIR, bearing No 209/2000, was lodged at Quaidabad police station in District Malir.

They alleged that influential people of the area, with mala fide intention, named their political rivals in the murder of the petitioners mother.

The petitioners claimed that they approached police and other officials for an honest inquiry into the matter. But due to unwanted interference by some political leaders, ministers, and senior government officials the investigation report and the findings of the joint investigation team (JIT) were, deliberately and wilfully, not brought on record before the trial court as evidence.

They petitioners alleged that on Nov 14 some people of the area kidnapped both of them and kept them in wrong full confinement for more then 72 hours. They treated very badly and attempted to kill them, the petitioners claimed.

The petitioners were brought to the trial court Malir forcibly by the abductors to record evidence and to sign the compromise deal in favour of the accused. The petitioners somehow managed to get free. Thereafter the incident was brought to the notice of the trial court by the consul.

Thereafter the petitioners went to Malir City police station to lodge an FIR regarding their abduction and attempt to kill both the petitioners.

Police only recorded the statement but did not register an FIR.

In view of the above submissions it is respectfully prayed, that this court direct the respondent Nos 1 & 2 to submit the joint investigation team’s report of the respondent Nos 3 to 6, and direct the respond No 7 to register FIR of the petitioners dated Nov 17, regarding their abduction and attempt to murder.

highrise CASE: A constitution petition filed by Abdul Qadir Siddiqui, former Sindh law secretary, challenging the construction of a highrise building in violation of the approved building plan came up for further hearing before a division bench of the Sindh High Court.

The bench comprised Justice Ghulam Rabbani and Justice S. Ali Aslam Jaferi.

The petitioner, now a practising lawyer, through his counsel, K. M. Nadeem and Nooruddin Sarki, had challenged the construction of a highrise building on plot No 82-J in Block-2 in PECHS next to a plot owned by him.

The petitioner had complained that Block-2 of PECHS was a residential locality where construction beyond ground plus one floor was not permissible. As such a building plan was approved for ground plus one floor in respect of plot No 82-J. But the builders/owners, ie, Maqbool Husain and others, were engaged in construction beyond first floor and had violated the requirement of keeping open space, the deviation of which was also pointed out by PECH Society.

On the previous date of hearing after hearing the petitioner’s counsel, the court had passed an order restraining the builders/owners from raising construction in violation of the approved building plan.

The counsel for the petitioner urged that the owners of the plot had accelerated the construction work in order to frustrate the petition. Therefore, the court, on the application of the petitioner, had appointed Nazir of the court as commissioner to inspect the premises in question to ascertain the extent and stage of construction and to file his report with the court before the next date of hearing and adjourned the matter to a date in office.
