Court summons senior ACLC officers in illegal detention case

KARACHI, June 2: A sessions court summoned an SSP and a DSP of the anti-car lifting cell (ACLC) for June 8 in a wrongful detention case.

On the directive of a sessions court, a bailiff raided the ACLC (Artillery Maiden) police station on Thursday and recovered Sarfraz, who had been kept there for four days allegedly without any charge.

When the matter came up for hearing before the in-charge judge of the district and sessions court (south), Abdul Razzaq, on Friday the bailiff submitted his report.

The bailiff said in the report that the raid was conducted along with an applicant and his lawyer and the man was found confined at the police station.

The report further stated that the bailiff got the victim released on personal bond since the police failed to produce any FIR or an entry in the daily diary to justify the detention of the man and directed the station house officer and others as well as the applicant party to appear in court on Friday.

When the SHO and an investigating officer appeared in the court, the judge came down hard on them as they failed to give any satisfactory reply about the man’s detention. Subsequently, the court issued notices to the senior superintendent of police and the deputy superintendent of police of the ACLC for June 8.

The applicant and his lawyer were also present in the court during the Friday proceedings, but the victim did not turn up and the applicant informed the court that he was unaware of the timing of the hearing.

The judge said he feared that the victim might have been picked up again by the police and ordered to ensure his presence on next hearing.

Earlier, the victim’s father, Munir Masih, had filed a habeas corpus application under Section 491 of the criminal procedure code and submitted that his son was picked up from their house in Christian Town, Korangi, on the morning of May 27.

He contented that the victim had been detained at the ACLC police station unlawfully, and prayed to the court for his recovery.
